Die Effektivität des EU-Rechts in der Krise der Europäischen Union

The Jean Monnet – Centre of Excellence on “The Effectiveness of EU-Law in Times of Crisis” (EfEU) analyses the legal principle of effectiveness established by the European Court of Justice. The Centre explores the legal, cultural, political and economic dimensions of this principle in the context of the current crisis of the EU. The proposal builds on the successful Roadmap-Project (Jean Monnet Centre of Excellence, decision no. 2011-3445/0), an in-depth-analysis of Better Regulation, but addresses new and very different questions of EU-law-enforcement. The crisis of the EU is manifest. The perception of the principle of effectiveness remains ambivalent: On the one hand, public opinion criticizes the lack of effectiveness of EU-law, esp. with respect to the refugee- and the financial crisis. On the other hand, it criticizes the EU when it promotes and enforces European integration (too) effectively, allegedly without a political mandate, thus provoking defensive reflexes in the Member States. The EfEU project examines these (in-)coherencies and the instruments rendering EU-law more effective. The project involves our strategic partners, the Université Paris 1 (Panthéon Sorbonne) and the UAM Poznan (Uniwersityt im. Adama Mickiewiscza), and carries out an innovative research- and dissemination programme based on four coordinated discussion forums. The lecture series (1) provides the framework for an international discourse on effectiveness. An “Interdisciplinary Summer” (2017) is part of this lecture series. The subsequent controversial debates (2) touch upon controversial legal and political questions . The conferences (3) focus on effectiveness in selected areas of the law such as consumer protection in European financial markets. In order to ensure the impact and the visibility of the project research results will be published, will be made available on the digital open access science-platform and will be addressed during business and public-policy workshops (4).
