SPREADING SOLUTIONS FOR NEW CHALLENGES OF EU COMPETITION LAW

The course aims at offering comprehensive and in-depth training on the new challenges of the European Competition law and policy. Since this is a proposal for a Jean Monnet Module, teaching will be the core activity, even though research will be also necessary to be completely updated with the constant and rapid evolution of Competition Law. The course aims at a specialised teaching on European Competition Law developments, including case law. Under the title of “SPREADING SOLUTIONS FOR NEW CHALLENGES OF EU COMPETITION LAW” the course will cover the followings key points:1.- Parallel trade problems, specifically in the Pharmaceutical sector. 2.- Specific problems for competition in the Energy sector 3.- Competition law and Intellectual Property Rights 4.- Bid Rigging 5.- Unfair practices distorting competition 6.- Enforcement: A. Recent developments in Private Enforcement. B. The scarce adoption of Interim Measures in Competition procedures.The knowledge of competition law is very valuable for business engaged in national and international trade, for consumers and consumers associations, and for public administrations. Consequently, this set of courses is aimed not only at graduates students, but also to consumers and Business Associations and to regional public workers. It is well-known, since the UE Treaty, the Common Market is a prior objective for the Institutions and the free movements of goods is a key instrument to obtain it. In this context, all the Institutions that will be analysed have a clear impact on it. There is valuable and recent case law and legal dispositions on parallel trade, Energy sector, Bid rigging or private enforcement that make them hot topics that are unfortunately neglected in University's studies.
