Legal work requires no longer only to be familiar with national codes and to apply them. Rather European law influences national legal systems. European law affects more and more areas of national law. This progress happens either directly by means of regulations or indirectly by means of directives. However, only the substantive law is in focus in the provisions. To answer the question of effective law enforcement, it often has to be resorted to national conditions. Although the Court of Justice of the European Union (ECJ) has attached importance to law enforcement through some instruments (State liability, effet utile, etc.), several areas of law still have deficits. The project aims to identify these deficits and develops new solution with the help of comparative law and interdisciplinary methodology to improve law enforcement. Only if European Law is enforced, a European Union will develop with a single European market, in which the “rule of law” can equally ensure legal certainty in 28 Member States. The initial hypothesis of this project is therefore that the various fields of law can learn from each other due to the different and numerous tools of law enforcement as well as due to different experiences. The investigation is especially focusing on the following fields of law: Antitrust LawState Aid Law and Procurement LawConsumer Protection LawCapital Markets Law/ Corporate LawThe planned Centre of Excellence involves researchers from Germany, France, Italy and China to provide a perspective beyond national borders and promote international and interdisciplinary exchange that benefits not only the research facility but also the vocational training of students, inspires policymakers and integrates the public.
